1. Introduction

This privacy policy (“Policy”) has been implemented by Codetta Music performance Examinations (“Codetta”) for you to understand how we accept, process and administer examinations and collect and use personal information (i.e., information that identifies a specific person, such as full name or email address) throughout your interaction with Codetta via our website https://codettamusicexams.ca/ (“Website”) and the provision and obtaining of an examination (collectively, the “Services”). In this Policy, unless otherwise defined or the context otherwise requires, all capitalized terms shall have the meanings specified in the Codetta Rules and Regulations.  

This Policy applies to all “users” of the Services, including both those who interact with the Website without being registered, or registrants who have Registered for the Services, and/or provided an online video for examination to Codetta. 

By using the Website or otherwise obtaining the Services, you agree to this Policy. If you do not agree, you should not interact with the Website or otherwise provide Codetta with your personal information.

2. What type of information does Codetta collect and how is it collected?

Codetta may collect information that has been provided to us directly by you when you Register for the Services, provide an online video of your performance and communicate with us through email, phone, and/or access our Website This information may include, for example, name, email address, teacher’s name or music school name, gender, birth date, credit card number, the information you choose to include in an email, internet or network activity such as browsing history, or any other information voluntarily disclosed by you. 

Cookies. Like many websites, our Website requires that you accept cookies in order to use it. Cookies are small bits of data that are placed on your computer by websites that you visit to automatically collect information to enable the website to recognize you. These technologies may also collect and store information about your usage of the Website, such as pages you have visited or content you have viewed. Cookies do not contain any personal details.

3. How does Codetta use and disclose this information?

Codetta uses the information Codetta collects from and about you to provide the Services, including 

  • Applicant administration;
  • Maintaining contact directories;
  • Advertising or marketing;
  • Responding to inquiries; 
  • Processing requests, payments, and preventing fraud;
  • Complying with applicable contracts, legal and regulatory requirements; 
  • in connection with a merger, sale, acquisition of assets, or corporate reorganization.

Codetta may also use the information Codetta collects from you for these additional purposes:

  • To make available to certain third-party service providers, such as contractors, agents or sponsors, who help us manage or provide the Services.
  • To periodically send promotional materials or notifications related to the Services. If you want to stop receiving promotional materials, follow the unsubscribe instructions at the bottom of each email. There are certain service notification emails that you may not opt out of, such as notifications of changes to the Services or policies.

Codetta Does Not Sell Your Personal Information.

4. How does Codetta protect this information?

Codetta uses reasonable administrative, technical, personnel and physical measures to safeguard information in its possession against loss, theft, unauthorized use, disclosure or modification. However, no one can guarantee the complete safety of your information. 

Third-Party Sites. Please note that third-party websites to which users upload their video examination (e.g. YouTube, Vimeo, or any other hosted video service) (“Third Party Sites”) may also collect information in accordance with their own privacy policies and practices. Privacy choices you have made on the Third Party Sites will not apply to our use of the information we have collected directly through our Website. We encourage you to read the privacy policies of the Third Party Sites that may collect your information. Codetta will have no liability for any Third Party Sites’ use of a user’s information.

5. How do I access or control my information?

Codetta may periodically send you emails regarding the Codetta Services, or for other marketing or advertising purposes. You may opt-out of receiving emails from Codetta by following the unsubscribe instructions provided within such correspondence.

You may have certain rights to access, update and correct the personal information we have collected from you. To request that Codetta provide access to, update, correct and/or delete your personal information in our system, please contact us at contact@Codetta.com. Codetta will try to comply with your request(s) as soon as reasonably practicable. We may deny a deletion request if retaining the information is necessary for us or our service provider(s), to the extent permitted by applicable law.

Data Retention. We will retain information for the length of time needed to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by law.Codetta may also retain backup information related to your Registration for some time for fraud detection purposes, or to comply with applicable law or our internal security policies. It is not always possible to completely remove or delete all of your information due to technical constraints, contractual, financial or legal requirements.

6. Other Information

Location of Information. The Website is hosted in and managed from Canada. If you are a user located outside Canada, you understand and consent to having any personal information processed in Canada. Canada’s data protection and other relevant laws may not be the same as those in your jurisdiction. The personal information of residents subject to the General Data Protection Regulation (“GDPR”) may be processed outside the European Economic Area. 

Sensitive Information. Codetta asks that you not send or disclose to us, any sensitive personal information (such as social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, etc.) on or through the Website or otherwise.

Children’s Privacy. Protecting the safety of children when they use the internet is very important to us. The Website is not designed or intended for use by children or anyone under the age of 13. Codetta expects that parents or legal guardians will register their children for the examination, and by registering their child(ren) for the examination, they thereby consent to the collection of the personal information of their children provided to Codetta. Codetta does not knowingly collect information directly from children.

Updates to Policy. Codetta may modify this Policy at any time. The “Last Updated” date at the bottom of this Policy indicates when this Policy was last revised. Any changes to this Policy will become effective when Codetta posts the revised Policy on the Website.
